Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Kinlog ("the App"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the App. These Terms of Service constitute a legally binding agreement between you and Kinlog's developer.

2. Description of Service

Kinlog is a fitness tracking application that uses AI-powered pose detection to count squat repetitions, track workout progress, and reward users with NFT badges on the Solana blockchain. The App is designed for use on Solana Seeker (Android) devices and is operated by an independent developer based in the Republic of Korea.

3. User Responsibilities

You are responsible for:

Using the App in a safe physical environment with adequate space
Ensuring you are physically fit to perform squat exercises
Consulting a healthcare professional before beginning any exercise program
Securing your own Solana wallet and private keys
All transactions made from your connected wallet
Complying with all applicable laws in your jurisdiction

4. Health & Fitness Disclaimer

⚠️ Important: Kinlog is not a medical device and does not provide medical advice. The pose detection and rep counting features are for informational and motivational purposes only. Always consult a qualified healthcare or fitness professional before starting a new exercise routine.

Kinlog and its developer are not liable for any injury, health issue, or physical harm arising from use of the App. You acknowledge that physical exercise carries inherent risks and that you assume full responsibility for your physical safety while using Kinlog.

5. Blockchain & NFT Terms

Kinlog enables minting of NFT badges on the Solana blockchain. By using this feature, you acknowledge:

Blockchain transactions are irreversible once confirmed
NFT badges are digital collectibles with no guaranteed monetary value
You are solely responsible for any transaction fees (gas fees) incurred
Kinlog does not control the Solana network and is not liable for network outages, congestion, or failed transactions
Your public wallet address will be recorded on the public blockchain
Cryptocurrency and NFT regulations may vary by jurisdiction; you are responsible for compliance with applicable laws in your region

6. Intellectual Property

Open Source Code: Kinlog's source code is released under the MIT License. See the LICENSE file for details.

Proprietary Assets: NFT badge artwork, app design, brand identity, and other creative assets remain the exclusive property of Kinlog's developer. You may not reproduce, distribute, or create derivative works of these assets without express written permission.

Third-Party Components: Kinlog uses MediaPipe (Apache 2.0 License) and other open-source libraries. All third-party licenses are respected and maintained.

7. Limitation of Liability

Kinlog is provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by applicable law, the developer shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the App, including but not limited to:

Data loss or corruption
Physical injury or health issues
Financial loss related to blockchain transactions
Service interruptions or technical failures
Third-party service failures (Solana network, Firebase, etc.)

8. Privacy

Your use of Kinlog is also governed by our Privacy Policy, which is incorporated into these Terms of Service by reference. The Privacy Policy describes your rights under GDPR, CCPA, PIPA, and other applicable data protection laws.

9. Governing Law & Jurisdiction

These Terms of Service are governed by the laws of the Republic of Korea, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms of Service or your use of Kinlog shall be subject to the exclusive jurisdiction of the courts located in Seoul, Republic of Korea.

For users located in the European Union or other jurisdictions with mandatory consumer protection laws, this clause does not affect your statutory rights to bring proceedings in your country of residence.

10. Modifications

We reserve the right to modify these Terms of Service at any time. Updated Terms will be posted on this page with a revised effective date. Material changes will be communicated through the App or via email when possible. Continued use of the App after modifications constitutes acceptance of the revised Terms of Service.

11. Termination

You may stop using Kinlog at any time. We reserve the right to terminate or suspend access to the App for users who violate these Terms of Service. Upon termination, your right to use the App ceases immediately, but provisions related to intellectual property, liability, and dispute resolution survive termination.
